These Terms of Service govern use of MzEmily.com and purchases made through the store. MzEmily.com is operated by MLECD Solutions, LLC, doing business as Mz Emily. By accessing the site or placing an order, you agree to these Terms and the policies incorporated here, including our Privacy Policy, Refund & Return Policy, and Shipping & Delivery Policy.
This store offers retail merchandise. Coaching, consulting, personal services, and entertainment services are not sold through this store.
1. Adults Only and Lawful Use
The adult-shopping portions of the site are intended only for people age 18 or older who meet the applicable legal age requirement and have legal capacity to enter a contract. By accessing or purchasing from those portions, you represent that you meet the age requirement and that possessing, purchasing, receiving, and using the selected products is lawful in your location.
2. Product and Store Information
We make reasonable efforts to present product descriptions, dimensions, materials, colors, compatibility, prices, inventory, images, and availability accurately. Some information originates with manufacturers and authorized product-data sources. Photography, packaging changes, production variations, and device displays can affect appearance. We may correct errors, update information, limit quantities, or cancel orders affected by inaccurate information or unavailable inventory.
3. Orders and Acceptance
An order confirmation acknowledges receipt of an order but does not necessarily mean that the order has been finally accepted or shipped. We may verify payment, identity, address, inventory, product restrictions, fraud signals, and other information before acceptance. We may decline or cancel an order for legitimate legal, safety, inventory, pricing, processor, or shipping reasons. Any required refund will be issued according to applicable law and our policies.
4. Prices, Payments, and Taxes
Prices are displayed in United States dollars unless stated otherwise. You authorize the payment provider to charge the amount shown at checkout, including applicable shipping and taxes. Payment processing is provided by third parties under their terms and privacy practices.
Promotional, referral, and influencer coupon discounts cannot be combined unless an offer explicitly states otherwise. When more than one eligible discount is entered or applied to a cart, Shopify applies the best eligible discount. Eligibility, exclusions, and expiration dates shown for an offer still apply. Store credit is a payment method and is subject to the terms under which it was issued.
5. Shipping, Returns, and Refunds
Shipping estimates, discreet-delivery practices, delivery problems, cancellations, returns, hygiene exceptions, and refunds are governed by our Shipping & Delivery Policy and Refund & Return Policy. Those policies form part of these Terms.
6. Product Safety
Read and follow manufacturer instructions, warnings, cleaning guidance, compatibility information, and age restrictions. Inspect products before use and stop using anything damaged or painful. Store content is educational and commercial information, not medical, mental-health, legal, or emergency advice.
Products involving restraint, impact, electrical stimulation, suspension, insertion, reduced mobility, breath restriction, or other higher-risk practices require informed consent, appropriate education, communication, monitoring, and emergency planning. We do not encourage unsafe or nonconsensual use.
7. Accounts and Security
Customer accounts are optional. You are responsible for safeguarding login credentials and for information submitted through your account. Notify us promptly of suspected unauthorized use.
8. Prohibited Conduct
You may not use the site to violate law; exploit or harm another person; engage in fraud; submit malicious code; interfere with the store; bypass security or age restrictions; misuse intellectual property; harass others; or purchase products for illegal, nonconsensual, abusive, or unsafe purposes.
9. Intellectual Property
The Mz Emily name, logos, artwork, site design, original text, graphics, and other brand materials are owned by or licensed to MLECD Solutions, LLC. Product names and third-party trademarks remain the property of their respective owners.
10. Third-Party Services
The store uses Shopify and other third-party payment, fulfillment, shipping, analytics, and technology services. Their services may be governed by separate terms and privacy practices.
11. Disclaimer and Limitation
Except for express warranties stated in writing and rights that cannot legally be excluded, the site and products are provided on an “as available” basis. To the fullest extent permitted by law, MLECD Solutions, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Nothing in these Terms excludes consumer rights or liability that cannot legally be limited.
12. Governing Law
These Terms are governed by the laws of the State of Missouri and applicable United States law, except where mandatory consumer law provides otherwise.
13. Changes to These Terms
We may update these Terms from time to time. The date shown at the top identifies the most recent revision. Changes apply prospectively unless applicable law requires otherwise.
